Sticky Club South Island SHOP'nGO Terms and Conditions

Important: Initially the Sticky Club SHOP’nGO service will only be available at selected PAK’nSAVE stores.


1. Membership

 

1.1 The PAK’nSAVE Sticky Club SHOP’nGO service (“SHOP’nGO”) is operated by Foodstuffs (N.Z.) Limited (“Foodstuffs”).

 

1.2 SHOP’nGO is currently available at all PAK’nSAVE stores except Invercargill. Foodstuffs will advise customers when SHOP’nGO is extended to other PAK’nSAVE stores.

 

1.3 SHOP’nGO is only available to registered members of the PAK’nSAVE Sticky Club. If you are not a member of the Sticky Club programme, you will first need to join Sticky Club before you can apply to use SHOP’nGO. 

 

Sticky Club membership is free. To join, simply pick up a Sticky Club Tag in-store (initially South Island stores only) and register either online at stickyclub.co.nz, in-store at the Sticky Club kiosk or by phoning the Sticky Club Call Centre on 0800 80 75 75 during normal business hours.

 

1.4 Before you can use SHOP’nGO, you must apply in-store by completing a short registration process with a PAK’nSAVE store staff member and present a valid form of photo I.D., being driver's licence, passport, or other I.D. provided that it contains your name, date of birth, a photograph and has not expired. A copy will be retained by the store. Membership and usage of SHOP’nGO are free of charge. 

 

1.5 You cannot register another member of your Sticky Club household for SHOP’nGO. All registrations for SHOP’nGO must be made in person by the registered PAK’nSAVE Sticky Club member. 

 

1.6 Foodstuffs reserves the right in its sole discretion to decline an application for SHOP’nGO at any time and is not required to provide a reason for doing so. 


2. Acceptance of Terms and Conditions

 

2.1 These Terms and Conditions (together with any amendments from time to time) govern SHOP’nGO. Registering to use SHOP’nGO or your use of the service will be deemed acceptance of these Terms and Conditions. 

 

2.2 Foodstuffs reserves the right to amend the SHOP’nGO Terms and Conditions, at any time, and will communicate any changes by publishing revised Terms and Conditions at stickyclub.co.nz. Your use of SHOP’nGO following any changes to the Terms and Conditions will be deemed acceptance of the updated Terms and Conditions.

 

2.3 Foodstuffs also reserves the right to withdraw SHOP’nGO at any time without notice. 

 

2.4 Foodstuffs may for any reason suspend or cancel your registration to use SHOP’nGO immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. 


3. Usage

 

3.1 To use SHOP’nGO, you must first check in at the SHOP’nGO station in-store by using either your registered Sticky Club tag or the Sticky Club SHOP’nGO Mobile App (which can be downloaded from the App store or Google Play store) before starting your shop. In either case, you must be the registered owner of the associated Sticky Club tag. 

 

3.2 To start shopping, scan your Sticky Club tag at the SHOP’nGO station to release a scanner or using the Sticky Club SHOP’nGO Mobile App on your smartphone, scan the QR code at the SHOP’nGO station to sync your phone to the local store.  

 

3.3 You cannot use SHOP’nGO by scanning another person’s Sticky Club tag or use their details to create an account on the Sticky Club SHOP’nGO Mobile App, even if that person is a member of your Sticky Club household. We reserve the right to request to see photo I.D. to confirm both your identity and SHOP’nGO membership at any time during your shop. 

 

3.4 All grocery items must be scanned before being put into your shopping trolley or basket. If you are buying more than one of the same item, you must scan each product individually. You may only use one trolley or basket during your shop and not share it with anyone else.  

 

3.5 For loose products, you must either scan the shelf barcode (if there is one) or use the weigh scales located in the Produce and Bulk Foods areas to print out a barcode, attach it to the product and scan it as normal. 

 

3.6 1.1   Age-restricted products (e.g. alcohol) may be scanned and added to your trolley. When you get to the checkout a PAK’nSAVE store staff member will be alerted to come and approve any age-restricted products.

 

3.7 You agree to advise the checkout attendant of any items which, for whatever reason, have not been scanned while using SHOP’nGO so they can be scanned and added to your transaction at the end of the shop. 

 

3.8 From time to time, your shopping transaction may be randomly selected by the system for a service check which will involve re-scanning a proportion or all of your groceries for accuracy. You agree that your shopping may be re-scanned at random intervals or at any time as required by a PAK’nSAVE store staff member. If there is a difference in price between your scan and the re-scanned items, then the prices for the re-scanned items will take precedence and be included in the transaction total.   As part of this process you also agree the PAK’nSAVE store staff member may look in any bag or bags you have with you to ensure all groceries are included in the re-scanning process.  

 

3.9 You may also request at any time for the contents of your shopping trolley to be re-scanned in full in the event that you think a pricing error has been made. 

 

3.10 Payment is made at the designated SHOP’nGO checkout. You agree to pay the total shown on the checkout screen at the end of your transaction or following a re-scan from a service check as appropriate. After you have paid, you agree to put the scanner in the collection box provided.

 

3.11 You agree to use SHOP’nGO with reasonable care, and not to cause damage or loss to the SHOP’nGO scanners. 

 

3.12 Foodstuffs reserves the right to refer the matter to the Police if it considers that misuse of SHOP’nGO has taken place. 

 


4. Privacy

 

4.1 Foodstuffs through its related companies, Foodstuffs South Island Limited and Foodstuffs North Island Limited, collects and holds personal information in accordance with its obligations under the Privacy Act 1993 (Privacy Act).

 

4.2 By using SHOP’nGO, you agree to Foodstuffs:

Collecting information about you, including registration details and your identification details, information about how you use SHOP’nGO, your purchases, and any other information that you give Foodstuffs;

Using your information to manage and improve SHOP’nGO, check and confirm your identity and Sticky Club membership, and prevent or detect crime;

Using your information to build up a profile based on the accuracy of any service checks that have been carried out. As part of fraud prevention, your profile score together with random sequencing and unexpected behaviour whilst shopping (for example a high number of unrecognized barcodes being scanned) will be used by the system to calculate the frequency of service checks and to review your ability to continue using SHOP’nGO;

Sharing your information with a PAK’nSAVE store which provides SHOP’nGO so they can operate the service and to assist with fraud prevention;

Contact you (or allow a PAK’nSAVE store staff member to contact you) in relation to store transactions where you have used SHOP’nGO; or

Undertake data analytics, insights or data mining (including the anonymisation or aggregation of your personal information with other data) to identify patterns and trends and use the full benefit of that analysis.

 

4.3 Under the Privacy Act you have the right of access to and correction of personal information and can do this by updating your existing member account at stickyclub.co.nz, at the in-store Sticky Club kiosk or by calling the Sticky Club Call Centre on 0800 80 75 75. Your personal information will be held by Foodstuffs (N.Z.) Limited at 167 Main North Road, Papanui, Christchurch 8140.

 


5. Governing law and disputes

 

5.1 SHOP’nGO is governed by New Zealand law. If we have any issues which need to be resolved by a Court, you agree to the exclusive jurisdiction of New Zealand Courts.


6. General

 

6.1 Foodstuffs is not liable for any delay with registering you for SHOP’nGO, or any system outages that prevent you from using SHOP’nGO.
